This is an appeal from an order of the circuit court sustaining a demurrer to the amended bill of complaint and dismissing said bill for want of equity.

The amended bill charges that Stephen- P. Kazwell, complainant, and Samuel J. Reynolds, defendant, entered into a written contract on or about May 21,1926, for the purchase and sale of a 10-acre tract of land located in the village of Palos Park; charges that the complainant stated to the defendant on several occasions that he intended to use the real estate as a sandwich shop or restaurant and to install on said premises a gasoline station.…
