CHRISTIAN, Judge.
The offense is murder; the punishment confinement in the penitentiary for five years.
The offense was committed on the 2nd day of July, 1923. The indictment was returned on the 11th day of June, 1926. The facts relied upon by the state were substantially as follows : The deceased, Otto Lange, was sitting on his porch on the night of the homicide. Four masked men drove to his house.
