This is an action for breach of an insurance contract issued to the plaintiff under the provisions of G.L. c. 90, § 34M (the “No Fault” Personal Injury Protection — “PIP”-Law). The plaintiff alleges in his complaint that he sustained personal injuries as a result of a two-vehicle collision upon a public way within the Commonwealth of Massachusetts and that he promptly notified the defendant insurance carrier.
