ATWELL, District Judge.
The complainant is doing business under the name of the Ozark Motor Lines. He operates as a common carrier, by motor, between Fort Worth, Tex., and Little Rock, Ark, via Dallas, Greenville, Paris, and Texarkana. He claims that he handles only interstate commerce. Prior to the passage of the Federal Motor Carrier Act, 49 U.S.C.A. § 301 et seq., on June 13, 1934, the Railroad Commission of Texas issued him an interstate certificate authorizing him to transport interstate commerce, oyer Texas highways between Fort Worth and Texarkana.
