FOLLEY, Justice.
This is a usury suit in which the appel-lees, Morris Hirsch and James J. Plauche, plaintiffs below, were acting in a fiduciary capacity as trustees for the use and benefit of various holders of notes all growing out of the same transaction. The appellant, I. H. Anderson, was the principal defendant below, however, other lienholders were parties to the suit, either as defendants or in-terveners, including the Sterling National Bank & Trust Company of New York.
