The plaintiff is a corporation engaged in business as a dealer in sheet piling, steel rails and accessories. In August, 1931, it made an oral contract for the sale to E. O. Roberts, Inc., of steel sheet piling to be used by E. 0. Roberts, Inc., in connection with the performance of a bridge construction contract in New York. All the terms of the contract were thereafter confirmed in a letter signed by the plaintiff.
