Spencer, J.:

Plaintiffs have appealed from judgment which denied their challenge to the validity of a conditional use permit issued by the Board of County Commissioners of Jefferson County to N.R. Hamm Quarry, Inc. (Hamm), for the operation of a sanitary landfill in that county. Plaintiffs are the owners of real property adjacent to or in the near vicinity of the proposed landfill.

On July 24, 1975, the Jefferson County regional planning commission denied Hamm’s application for a conditional use permit to operate the landfill. On September 5, 1975, the Board unanimously reversed the decision of…
