The plaintiff’s motion for summary judgment has been denied and defendant’s motion for judgment on the pleadings granted and judgment dismissing the complaint entered. From the pleadings the following undisputed facts appear: The defendant bank on the 5th day of September, 1924, lent Jose Levy and Sadie Levy $9,000 and took their bond and mortgage therefor. The mortgage covered property in the city of Rochester at 36-38 Carthage road.
