Appeal from a judgment of the County Court of Madison County (DiStefano, J.), rendered June 5, 2008, convicting defendant upon his plea of guilty of the crime of manslaughter in the first degree.

*1159After beating his then-girlfriend to death, defendant was charged with murder in the second degree, manslaughter in the first degree and assault in the first degree. Pursuant to a negotiated plea agreement, he pleaded guilty to manslaughter in the first degree in full satisfaction of the indictment and waived his right to appeal.
