In an action, inter alia, to recover damages for medical malpractice, the defendant Srinivas Kesanakurthy appeals from an order of the Supreme Court, Kings County (Dabiri, J.), dated May 30, 2014, which denied his cross motion pursuant to CPLR 3211 (a) (8) to dismiss the complaint insofar as asserted against him and granted that branch of the plaintiff’s motion which was pursuant to CPLR 306-b for leave to extend the time within which to serve the summons and complaint upon him.
