Appeal from a judgment of the Supreme Court (Teresi, J.), rendered July 17, 2003 in Albany County, upon a verdict convicting defendant of the crimes of murder in the second degree and attempted murder in the second degree.

On the evening of June 3, 2001, Javan Morton was sitting on the steps of a flowershop on the corner of Elizabeth Street and Third Avenue in the City of Albany when teenagers Shakira Chambers and Stephanie VanDeBogart saw him as they were out for a walk. Morton warned the girls of danger and a possible retaliatory shooting because someone in a gang from “uptown” had been shot…
