FELDMAN, Vice Chief Justice.

David Yetman petitioned us to review a court of appeals opinion affirming the trial court’s refusal to instruct the jury on the issue of punitive damages in his defamation action against William English. English filed a cross-petition for review, claiming his remarks were absolutely protected expression under the first amendment to the United States Constitution and article 2, § 6 of the Arizona Constitution.
