*396In an action to recover damages for personal injuries, the defendant Edwin Boyce appeals from so much of an order of the Supreme Court, Bangs County (Kramer, J.), dated April 5, 2005, as denied his cross motion for summary judgment dismissing the complaint insofar as asserted against him.
Ordered that the order is affirmed insofar as appealed from, with costs.
