The Federal Deposit Insurance Corporation brought suit against A. Davidson West, individually, to recover overdrafts in the amount of $36,715.15 on checking account No. 0100201913-01 at the Hamilton Bank & Trust Company. The defendant answered, denying the material allegations of the complaint. Both sides moved for summary judgment and after a hearing the trial judge granted the plaintiffs motion for summary judgment and denied that of the defendant.
