Appeal from Monroe county court. Action by William H. Lockwood against Benjamin F. Lockwood. From a judgment for defendant, affirming a judgment of a justice of the peace, plaintiff appeals.

The action was brought to recover the possession of a sorrel horse. The defense was that, four years prior to the beginning of the action, the plaintiff gave this horse to the defendant, who took possession of it, and retained such possession, with the exception of about three months, when he was loaned by the defendant to the plaintiff for a special purpose. The ease presented to the justice of the peace was clearly one of fact.
