— Plaintiff’s petition is in three counts. The first alleges a confidential relationship between plaintiff and defendant A. J. Salem, in which the latter was the dominating party; it pleads fraud, both active and constructive, in procuring plaintiff’s signature to a deed to a valuable parcel of residence property in Sioux City, and alleges a mortgage given by A. J. Salem to defendant Rose Eckrosh to be likewise fraudulent. Count II repeats the factual allegations of Count I and charges undue influence exercised by A. J. Salem in securing the conveyance.
