Pretermitting an attempt specification which is of no relevancy to the action, the accused was charged with one bestial act with a chicken and a lewd and lascivious act with a three and one-half-year-old female child, both in contravention of Article 134 of the Uniform Code of Military Justice, 10 USC § 934. On his original trial he was found guilty and sentenced to a dishonorable discharge, total forfeitures, and to be confined for a period of five years.
