Defendant, Richard L. Goo-

dard, was convicted after jury trial of first-degree murder. MCL 750.316; MSA 28.548. He appealed and we reversed. People v Goodard, 82 Mich App 424; 266 NW2d 832 (1978) (Beasley, J., dissenting). The people moved for and we granted rehearing in an order dated August 31, 1978. On rehearing defendant’s conviction is affirmed and our former order reversing the conviction is rescinded.
