Affirming.
At the April, 1942, term of the Boyle circuit court the appellant, Rudolph Kratzwald, was indicted charged with murdering James Plummer, a deaf-mute. His trial thereunder was continued from term to term until the regular one in September, 1943, when he was convicted of voluntary manslaughter with an attached punishment of five years’ confinement in the penitentiary.
