In the court below, Clark declared in the common form against Badgley upon a bond. Badgley *288pleaded that the bond was usurious and void, and a verdict was found and judgment rendered for him. Clark seeks here to reverse the judgment, because the case made by the plea does not bring the bond within the reach of the statute-against usury. The plea is in substance as follows :—Before the making of the $ond it was corruptly agreed between the parties, that Clark should lend Badgley $250 for one year, and that Badgley for the loan of the $250,…
