Upon application of the petitioner, Frank J. Banach, this Court issued a writ of habeas corpus ad subjiciendum on May 5, 1963, returnable June 18, 1963, and appointed counsel to represent him before this Court.

The petition alleges petitioner’s indictment and conviction at the March, 1960, term of the Circuit Court of Wayne County, the overruling of his motion for a new trial and the imposition of a sentence to a term of 20 years in the state penitentiary, which sentence petitioner is now serving.
