This is an action, by Ben W. Tempero, plaintiff and appellee, against LaVelle E. Adams, defendant and appellant, for damages to person and property growing out of a collision between an automobile owned and operated by plaintiff .and a truck owned by the defendant and operated by an employee of his. The date of the occurrence was September 8, 1947. By his petition plaintiff claims that the collision came about by reason of the negligence of the employee of defendant who was operating the truck.
