This is an indictment for murder, tried in tbe Criminal Court of Mecklenburg County, in which the jury returned tbe following verdict: “Tbe jury say for their verdict upon oath that tbe said Will-Truesdale is guilty of tbe felony and murder in manner and form as charged in tbe bill of indictment.” Upon tbis verdict tbe prisoner was sentenced to be banged; from wbicb judgment be appealed to tbe Superior Court of said county. Tbe Judge of tbe Superior Court affirmed tbe judgment of tbe Criminal Court, and tbe prisoner appealed to tbis Court.
