SANBORN, Circuit Judge.

This is an appeal from a judgment for The Aetna Casualty & Surety Company (hereinafter referred to as “Aetna”), a third party defendant in an action brought , in May 1958 by Texaco-Cities Service Pipe Line Company, a Delaware corporation, as plaintiff, against Clell Hedgpeth and Frank Stewart, partners doing business as Hedgpeth & Stewart, as defendants, to recover damages caused by an injury to the plaintiff’s pipe line, allegedly due to the negligence of one of the defendants’ employees.
