Essentially this is an action to set aside an issue of land trust certificai.es issued by the defendant, the Union Trust Company as trustee, on the ground that said issue *41was beyond the power of said defendant, void and without legal effect. The case has been submitted upon an agreed statement of facts. The statement of facts is so extensive that in the interest of brevity a consideration thereof is deemed advisable and only so much thereof is included herein as may be deemed necessary for an understanding of this opinion.
