— Appeal by the People from an order of the Supreme Court, Queens County (Rotker, J.), dated June 20, 1985, which granted the defendant’s motion to dismiss the indictment charging him with manslaughter in the second degree and criminal possession of a weapon in the third degree.

Order reversed, on the law, motion denied, indictment reinstated, and matter remitted to the Supreme Court, Queens County, for further proceedings.
