Evan George, appellee here, sued bis brother, John L. George, appellant, to recover damages on account of an injury alleged to have been suffered on the early morning of November 23, 1932, in an automobile accident. The parties to the suit were living at Beebe, in White County. About midnight John L. George and a Mrs. Garner, with whom he was boarding, invited Evan George to go with them upon a ride from Beebe to Austin in Lonoke County.
