Petitioner, an inmate at the Bedford Hills Correctional Facility, commenced this proceeding pursuant to CPLR article 78 to challenge the structure of the temporary release committees established pursuant to 7 NYCRR 1900.2 (a) and as staffed by respondent, as Commissioner of the Department of Correctional Services. In particular, petitioner challenges the propriety of having employees of the State Division of Parole, i.e., parole officers, serve on the release committees.
