Appeal from Decatur District’Court. — Hon. John W. Haevey, Judge. Indictment charging that the defendant, in the county of Ringgold, did unlawfully enter a certain cemetery, commonly called the Mormontown Cemetery, and therein did disinter and remove, without lawful authority, the dead body of Arthur Lynch. ‘ There was a trial to a jury, verdict of guilty, and judgment. The defendant appeals.

1. Evidence: residence of witness: tendency to disgrace and impeach. — I. The defendant took the deposition of one Stevens, and the state, on cross-examination, asked the witness dfertain questions, which, and the answers thereto, are as fol-l°ws: “Where are you now living? A. Bedford. What are you doing there? A. Waiting for court to come. Where are you stopping at this time ? A. I am in the jail of Taylor county. How long have you been in jail ? A.
