This is an action for damages for the misdelivery of a carload of goods, shipped over the -defendant’s railroad to Mobile, Alabama.

On the twenty-first day of. December, 1888, the Royster Provision Company of Birmingham, Alabama, shipped a carload of dressed beef from Sioux City, Iowa, to the city of Mobile, over the Illinois Central •and the Mobile and Ohio railroads.
