Casey, J.
In March 1982, defendant and Robert Huntington were indicted on charges of murder in the second degree arising out of the strangulation death of defendant’s ex-husband. Huntington pleaded guilty as charged and was the prosecution’s chief witness at defendant’s trial in 1983, at which defendant testified in her own behalf. The jury found defendant guilty of murder in the second degree, but the Court of Appeals reversed the conviction and ordered a new trial (68 NY2d 520).
