WERLEIN, Justice.

This suit was brought by appellants to recover damages for personal injuries allegedly sustained by appellant, Juana Robles Nieto, on October 12, 1959 when she fell from a ladder or stool while attempting to replace her safe deposit box in its slot or pigeon hole in the safe deposit vault of the United States National Bank of Galveston. After the jury had been retired for approximately seven hours and had indicated to the trial court that it was hopelessly deadlocked on the first issue pertaining to liability, the court, on motion of appel-lee, withdrew the case from the jury…
