FINNEGAN, Circuit Judge.

Plaintiff was injured while riding as a passenger for hire in defendant’s taxicab when it became involved in a collision with a military vehicle1 at the intersection of Cicero and Archer Avenues, Chicago, Illinois. For injuries sustained in this accident of May 27, 1952, plaintiff was awarded $35,000 damages against Yellow Cab Company, by a jury which accompanied its verdict, on June 26, 1953, with an answer to one interrogatory.
