CHRISTIAN, Judge.

The offense is murder; the punishment, death.

It was charged in the indictment in substance that appellant, with malice aforethought, killed Bess Burt by shooting her with a pistol.

The homicide occurred January 6, 1934, and the indictment was returned five days later. The trial began February 5, 1934. *571Appellant was too poor to employ counsel. Approximately two weeks before the trial the trial court appointed two attorneys of the Houston Bar to represent appellant.
