The most important question in this cause is, whether the City of St. Louis, under her charter, had authority to subscribe for stock in the Ohio and Mississippi Railroad Company. The charter of the city, at the time the subscrip*508tion was made, contained a clause wbicb prohibited the city at any time from becoming a subscriber for any stock in any corporation.
