The facts of the case, as stated in the prevailing opinion, are not disputed. Walter Laurent, who was a son of the plaintiff in this case, held an industrial life insurance policy) issued by. the defendant company, on December 17, 1923, of the face value of $88. The premiums, which were 10 cents per week, were paid regularly, up to the 14th of December, 1931, on which date the policy was permitted to lapse for nonpayment of premiums.
