LOVE, District Judge.

This case is before the court upon the demurrer of the defendants to the plaintiff’s petition. The plaintiff, who sues as assignee in bankruptcy, shows that the petition in bankruptcy was filed on the 1st of May, 1877, by certain creditors of A. Bernard & Co., against A.' Bernard and John G. Mead as the members composing that firm, and that on the 13th day of May, 1877, they were duly adjudged bankrupts; that on the 5th day of May, 1S77, the plaintiff was elected assignee of said estate of A.
