In the court below the plaintiff declared in damages, sustained by him, as he said, through the actionable fault of the defendants.
When the cause was put to trial to a jury, the evidence disclosed the fact that the plaintiff was born a subject of the dual monarchy of Austria-Hungary, never having been naturalized as a citizen of the United States, although he had resided in this country for several years and in Summit county for more than three years.
