MEMORANDUM OPINION AND JUDGMENT

TURK, Chief Judge.

Plaintiff has filed this action challenging certain provisions of his awards of “black lung” benefits and disability insurance benefits under the Federal Coal Mine Health and Safety Act and the Social Security Act, respectively. Jurisdiction of this court is pursuant to § 205(g) of the Social Security Act, 42 U.S.C. § 405(g), which is incorporated by the Federal Coal Mine Health and Safety Act under 30 U.S.C. § 923(b).
