The plaintiff, C. B. Chambers, recovered a judgment for $4,000 in the lower court, and the defendant, John J. Craig company, appealed.

The .defendant company owned and operated a large marble quarry in Blount County, Tennessee, and had in its employ the plaintiff, C. E. Chambers, a man twenty-seven years of age, as a helper on a chandling machine used in the removal of marble. While so engaged, on June 14, 1927; he was injured by falling marble.
