Caroline E. Toler, as plaintiff, instituted an action in the district court of Las Animas county against her sister, Marie Rose Bargas, to partition the real property described in the complaint, to divide certain furniture, and for an accounting of the rents and profits of the real property during the time that defendant allegedly withheld possession from plaintiff.
