The questions involved in this litigation are so clearly stated by Judge Arthur Webster in an opinion filed by him, that we quote from it as follows:

“The Detroit City Gas Company was operating in the city of Detroit under a franchise granted in 1898, which expired by limitation of time October 31, 1923. About the time this franchise expired negotiations were pending between the common council of the city and. the gas company relative to new rates. The company and the common council agreed to submit the whole matter to a board of arbitration, and this board, after a hearing lasting over…
