This is an action for trespass, in which treble
damages are requested for the willful and malicious destruction in December, 1938, of structures belonging to plaintiff.
On March 31, 1938, the Board of Estimate approved the selection by the Commissioner of Parks of lands for several parkways, including Shore Parkway, and authorized the acquisition of title thereto by purchase or condemnation.
