Appeal from a judgment of the Superior Court of the city and county of San Francisco, and from an order refusing a new trial. The facts are stated in the opinion of the court.

This action was brought to abate an alleged nuisance, and to procure an injunction. Defendants had judgment in the court below, from which, and from an order denying a new trial, plaintiff appeals.

The action was instituted by the attorney-general, in the name of the people of the state of California, on the relation of J. Britton, a citizen of the state, and a resident and tax-payer of the city and county of San Francisco, against the Park and Ocean Railroad Company, and the Pacific Improvement Company, — the latter defendant was, at the commencement of the action, engaged for the other…
