In this case the judgment of the circuit court of Daviess county in favor of the defendants, on appeal to the Kansas City court of appeals, was reversed and the cause remanded. But one of the judges of said court of appeals being of the opinion that the decision of the majority of the court, rendered therein, is contrary to a previous decision of the supreme court, the cause was certified to this, court under the *566provisions of section 6 of the constitutional amendment of 1884. R. S. 1889, p. 88.
