Appellants, J. T. Carter and M. W. Heltsley, and appellee, H. L. Tucker, formed a partnership in the latter part of the year 1908 for the purpose of securing options and leases on coal and mineral lands in and about Rockport, Ohio county, Ky. . Carter lived in Rockport and owned about 300 acres of land near *35the corporate limits of the town.
