The captioned cause is before this Court upon a motion by defendants Frank Homan and Auto Vehicle Parts Company (AVP) to dismiss plaintiffs’ amended complaint for failure to state a claim upon which relief can be granted, Fed.R.Civ.P. 12(b)(6).
