The appeal, in this case, is from an order of the Circuit Court of Baltimore City, passed on the 4th day of October, 1922, overruling the demurrer of the appellant to the petition of the appellee, for a writ of "habere facias possessionem3' against the appellant.

The petition, upon which the proceedings are based, avers in substance:
