In an action for a judgment declaring that the plaintiff is not *807obligated to defend or indemnify the defendant Joseph M. in an underlying action pending in the Supreme Court, Suffolk County, under index No. 14525/07, the plaintiff appeals from an order of the Supreme Court, Suffolk County (Molia, J„), dated November 30, 2011, which denied its motion for summary judgment declaring that it is not obligated to defend or indemnify the defendant Joseph M. in the underlying action.
