The defendant City of New York moves pursuant to section 749-aa of the Judiciary Law for an order directing that the issues raised in this action, brought to recover damages for wrongful death, be tried by a special jury.

Plaintiff’s intestate, Arnold L. Schuster, while approaching his home in Brooklyn, was shot and killed by an unknown assassin on March 8, 1952. Just 19 days before his death Schuster had supplied information to the Police Department of the City of New York which led to the apprehension and arrest of a notorious criminal and fugitive from justice known as Willie Sutton.…
